Comment on What You Need to Know About Writing a Colorado Power of Attorney by Sandra Shelley

My father is a resident of Colorado at an assisted living facility in Lakewood, CO. I am the only daughter who cared for both my parents here in Ohio. Unbeknownest to me, my brother convinced my parents to make him total POA. He also convinced them to move to Denver. My mother subsequently passed away after my brother moved both of them to Colorado approximately 1-1/2 years ago.

Since mom has passed, my 103 father would like to return to his home state of Ohio. He has stated this to my brother (his POA) and to his (dad's) attorney that he wants to return to Ohio. He has also requested that I be reinstated as co-POA, so that I could advocate his wishes for him. I have a notarized letter, signed by my father, to that affect. Mr. Frishman, my father's attorney, knows of dad's wishes and has known them for over a year, but continues to look the other way. Dad does not want to die in Colorado. He wants to be around familiar faces, territory and friends. This situation has been going on for over a year. I have spent thousands of dollars on Colorado attornies and without the cooperation of my father's attorney, the matter would have to go to court. I cannot afford this and my dad knows this so he has basically given up. There is a grave injustice being done against my father by his attorney and my brother. If things don't change soon, I am going to have to take legal action to file a formal complaint to the Colorado Attorney General's office against Mr. Frishman.
My question: is there any way to put a strong message to my brother and his my father's attorney that dad's rights are being violated? Even though dad is 103, he still has all his mental facilities and knows exactly what is going on and is powerless to do something about it. Your help (in any way) would be most appreciated.

I was served but the court papers did not have file date and file number. Is this a valid legal action. Do I still have to respond within 20 days since it's from a district court?

Somehow, between me and my husband, we have managed to accrue $17,000 in credit card debt. We can't seem to find a way out. We have tried to budget, we have done research, and we have even cut out alot of fun stuff in our lives. I think it's time for me to get a part time job. If we can't pull this off, we may have to declare backruptcy.
