Five Elements of Common Law Marriage in Colorado

Colorado recognizes common law marriages, meaning that it is valid, for all intents and purposes as if you had gotten hitched in a church, in front of a justice of the peace, or in Las Vegas.

According to the Colorado Attorney General’s website, the five elements are that the couples:

  1. are free to contract a valid ceremonial marriage, i.e., they are not already married to someone else;
  2. hold themselves out as husband and wife;
  3. consent to the marriage;
  4. live together; and
  5. have the reputation in the community as being married.

So, if you’re shacking up with someone and not sure he or she is “the one”, you might be unintentionally hitching yourself to the wrong cart.
